Welcome to Go Race Live ("Go Race Live", "we", "us", "our"). By creating an account, joining a race, or otherwise using our website, app, or related services (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
Important: Go Race Live is a software tool only. We do not organize, supervise, plan, vet, inspect, or run any race, location, route, or mission. Every race is created and run entirely by the game organizer ("Manager") and the people who choose to take part ("Participants"), who assume full and sole responsibility for it.
1. Who can use Go Race Live
You must be at least 16 years old to create a Manager account. Participants under 16 may join a race only with the consent and active supervision of a parent, guardian, or other responsible adult (for example a scout leader, teacher, or party host) who acts as the Manager and accepts full responsibility for them.
2. Your account
You are responsible for keeping your account credentials safe and for everything that happens under your account. Notify us promptly if you suspect unauthorized use.
3. Acceptable use
You agree not to use the Service to:
- Break the law, including local rules about trespassing, traffic, drones, or filming people.
- Harass, endanger, intimidate, or doxx other participants.
- Upload content you don't have the right to share, or that is illegal, hateful, or sexual.
- Disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service.
- Run a race in a location or manner that puts any person or property at risk.
4. Your content
You keep ownership of the missions, photos, videos, locations, and other content you upload. You are solely responsible for that content and for the rights, permissions, and consents needed to use it. You grant Go Race Live a worldwide, royalty-free license to host, display, and process that content solely to operate and improve the Service.
5. Manager responsibilities
If you create, configure, schedule, share, or run a race, you are the Manager of that race. You are solely responsible for, and Go Race Live has no responsibility for, all of the following:
- Choosing safe, legal, and accessible locations, routes, and checkpoints.
- Obtaining any permits, landowner permissions, and waivers required by local law.
- Assessing weather, traffic, terrain, lighting, wildlife, and other real-world conditions.
- Verifying that Participants are physically and mentally fit to take part.
- Supervising minors at all times, including the conduct of any adult guardians you delegate to.
- Providing first aid, emergency contacts, and a plan for incidents, lost participants, and SOS situations.
- The content, accuracy, and appropriateness of every mission, clue, photo task, and instruction you publish.
- Compliance with all laws on data protection, image rights, child safeguarding, and event organization.
6. Participant responsibilities and assumption of risk
Participation in any race is voluntary. By joining or playing, each Participant (or their parent/guardian if a minor) acknowledges and agrees that:
- Outdoor and location-based activities carry inherent risks, including but not limited to traffic, falls, weather, water, animals, strangers, getting lost, illness, injury, property damage, or death.
- They assume all such risks voluntarily and play at their own risk, and they are responsible for their own safety, conduct, equipment, decisions, and belongings at all times.
- They are responsible for following all laws, signage, instructions from authorities, and any additional rules the Manager sets.
- They will not rely on the Service for navigation, emergency response, time-critical communications, or safety-critical information.
7. No responsibility of Go Race Live — disclaimer of warranties
The Service is provided strictly "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or quiet enjoyment.
Without limiting the above, Go Race Live makes no representation or warranty, and accepts no responsibility or liability whatsoever, for:
- The safety, legality, accessibility, accuracy, or suitability of any location, route, checkpoint, mission, clue, or plan created or shared through the Service.
- The behavior, decisions, qualifications, supervision, or identity of any Manager, Participant, guardian, or other user.
- Any injury, death, illness, property damage, theft, arrest, fine, dispute, or other harm or loss arising out of or related to any race or any use of the Service.
- Map data, GPS accuracy, sensor data, weather data, network availability, SMS or email delivery, or AI-generated suggestions.
- Any content uploaded by users, including missions, photos, videos, and chat messages.
- Interruptions, bugs, delays, data loss, or unavailability of the Service.
Go Race Live does not endorse, supervise, or moderate races in real time, and is not an event organizer, tour operator, guide, custodian, or supervisor of minors. The Service is a neutral tool that you choose to use at your sole discretion and risk.
8. Limitation of liability
To the maximum extent permitted by applicable law, Go Race Live, its owners, officers, employees, contractors, and suppliers shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your access to, participation in, organization of, or inability to use the Service or any race, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability for any and all claims arising out of or related to the Service is limited to the greater of (a) the amounts you have paid to Go Race Live in the 12 months before the event giving rise to the claim, or (b) USD 50.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities (for example, for death or personal injury caused by negligence, fraud, or matters that cannot lawfully be limited). Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law. In those jurisdictions, our liability is limited to the smallest extent permitted by law.
9. Indemnification
You agree to defend, indemnify, and hold harmless Go Race Live and its owners, officers, employees, contractors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) any race you organize, run, or participate in; (b) your content; (c) your breach of these Terms or any applicable law; or (d) your violation of the rights of any third party.
10. Service availability and changes
We may change, suspend, or discontinue any part of the Service at any time, with or without notice. We try hard to keep things running but do not promise uninterrupted or error-free operation.
11. Termination
We may suspend or terminate accounts that violate these Terms. You can delete your account at any time from your profile. Sections 4–9, 12, and 13 survive termination.
12. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Go Race Live is established, without regard to conflict-of-laws principles. Any dispute will be brought exclusively in the competent courts of that jurisdiction, except where mandatory consumer-protection laws of your place of residence provide otherwise.
13. Order of precedence
If any part of these Terms appears to conflict with another, the sections that allocate responsibility and risk away from Go Race Live (sections 5, 6, 7, 8, and 9) prevail. If any provision is held unenforceable, the remaining provisions remain in full force.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in-app or by email. Continued use of the Service after changes means you accept the updated Terms.
